Please read these Terms & Conditions (“Terms”) carefully before placing an order, enrolling in a CSA subscription, or using any services offered by Garden of Gaea Urban Farm, LLC (“Garden of Gaea,” “we,” “us,” or “our”). By purchasing from us or using our website, you agree to be bound by these Terms.
1. Products & Services
Garden of Gaea Urban Farm, LLC is a small-batch urban microgreens farm based in Benton, Arkansas. We offer:
- Fresh microgreens and farm products for individual purchase
- CSA (Community Supported Agriculture) subscription boxes delivered on a recurring schedule
- Farmers market retail sales
- Add-on product offerings for existing subscription customers
All products are grown and harvested in small batches. Availability is subject to seasonal conditions, crop yields, and demand. We reserve the right to substitute a product of equal or greater value if a listed item is unavailable, and will notify you in advance when possible.
2. CSA Subscriptions
Enrollment
By enrolling in a Garden of Gaea CSA subscription, you agree to receive recurring deliveries of fresh microgreens and farm products on the schedule selected at sign-up. Subscriptions may be weekly, biweekly, or on another agreed schedule.
Billing
Subscription fees are billed in advance on a recurring basis (weekly, biweekly, or monthly depending on your plan). Payment is due before the delivery period begins. Failure to maintain a valid payment method on file may result in suspension or cancellation of your subscription.
Pausing Your Subscription
You may pause your subscription by contacting us at least 72 hours before your next scheduled delivery. Pause requests received after this window may not be honored for the upcoming delivery. We will do our best to accommodate requests on a case-by-case basis.
Cancellation
You may cancel your subscription at any time by contacting us at Brandon@thegardenofgaea.com or (501) 529-0630. Cancellations must be received at least 72 hours before your next scheduled delivery to avoid being charged and receiving that delivery. Refunds for deliveries already processed are handled on a case-by-case basis at our discretion.
Missed or Failed Deliveries
If you are not home at the time of delivery, we will leave your order in the agreed-upon location (e.g., front porch, insulated bag). Garden of Gaea is not responsible for product quality after delivery has been completed and confirmed. If a delivery cannot be completed due to an inaccessible address or no agreed drop location, you will be contacted and we will attempt to reschedule at no extra charge for the first occurrence.
3. Delivery
Delivery Area
We currently deliver within our established route zones in and around the Benton, Arkansas area. Delivery zones are subject to change. If your address falls outside our current delivery area, we will notify you prior to enrollment or as soon as possible if a zone change occurs.
Delivery Schedule
Delivery dates and time windows are provided when you sign up and may be communicated via email or SMS notification. While we make every effort to deliver within the stated window, delivery times may vary due to route conditions, weather, or other circumstances beyond our control.
Delivery Requirements
Customers are responsible for ensuring a suitable, accessible drop location is available on delivery day. For best product quality, we recommend having an insulated bag and previous deliveries ice packs (provided by us with your first subscription signup ) at your door for warm-weather deliveries. Garden of Gaea is not liable for product quality issues resulting from extended exposure to heat after delivery.
Delivery Fees
Delivery fees, if applicable, will be clearly stated at checkout or during CSA enrollment. We reserve the right to adjust delivery fees with advance notice.
4. Payments & Pricing
All prices are listed in US dollars. We accept payment through our online store (WooCommerce) and in-person via Square or cash at farmers market locations. We reserve the right to update pricing at any time. For existing CSA subscribers, price changes will be communicated at least 14 days in advance.
Invoices are due upon receipt unless otherwise agreed in writing. Accounts with overdue balances of more than 30 days may result in suspension of service.
We do not store your full payment card details. All payment processing is handled securely through Square and WooCommerce’s payment infrastructure.
5. Product Quality & Freshness
Our microgreens are harvested fresh and delivered as close to harvest as possible. Because our products are living or freshly cut plants with no preservatives, shelf life is limited. We recommend refrigerating your products immediately upon receipt and consuming them within the timeframe noted on your order or packaging.
If you receive a product that appears damaged, spoiled, or significantly below quality expectations at the time of delivery, please contact us within 24 hours with a photo and description. We will work with you to issue a replacement or credit on a case-by-case basis. We are not able to offer refunds or replacements for quality issues reported after 24 hours of delivery.
6. Allergens & Food Safety
Our products are grown in an urban farm environment. While we take reasonable precautions, we cannot guarantee that our products are free from cross-contact with common allergens. If you have a known food allergy or sensitivity, please contact us before ordering so we can advise you appropriately.
Garden of Gaea is not liable for adverse reactions resulting from undisclosed allergies or failure to follow safe food handling practices after delivery.
7. SMS Communications
By providing your phone number and opting in at checkout, you consent to receive SMS text messages from Garden of Gaea Urban Farm, LLC. Message types include delivery reminders, order updates, payment confirmations, and seasonal product offers.
Message frequency: Typically 4-6 messages per month based on your delivery schedule.

SMS consent is not a condition of purchase. You may opt out at any time without affecting your ability to place orders or maintain your subscription.
8. Intellectual Property
All content on our website, including text, images, logos, and branding, is the property of Garden of Gaea Urban Farm, LLC or its content providers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use our content without prior written permission.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Garden of Gaea Urban Farm, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of our products or services, including but not limited to loss of data, loss of revenue, or personal injury, even if we have been advised of the possibility of such damages.
Our total liability for any claim related to our products or services shall not exceed the amount paid by you for the specific product or service giving rise to the claim.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Saline County, Arkansas.
11. Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we do, we will update the “Last Updated” date at the top of this page. For material changes, we will provide notice via email or a website notification. Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
